TERMS AND CONDITIONS OF SALE

Please read the following terms and conditions of sale ("Terms and Conditions") carefully. These Terms and Conditions govern the sale by Liquor Control Board of Ontario ("LCBO") to you of products ("Products") and event tickets ("Event Tickets") through the LCBO's Vintages website located at www.vintagesshoponline.ca & www.vintagesshoponline.com (the "Website"). LCBO reserves the right to change these Terms and Conditions of Sale at any time without prior notice by posting changed Terms and Conditions of Sale on the Website, and you are advised to review the Website regularly for any changes. These Terms and Conditions of Sale were last updated on July 16, 2015. By placing an order through the Website, you agree to be bound by the Terms and Conditions in effect at the time of such order.

  1. ACCEPTANCE OF ORDERS

    Although every effort has been made to stock adequate quantities of the Products offered on the Website, some Products and Event Tickets are available in relatively small quantities and per-customer limits may be applied when customer demand exceeds supply. The LCBO may reject any order appearing to circumvent a per-customer order limit including, without limitation, where multiple orders are submitted with the same customer information.

  2. PAYMENT BY CREDIT CARD

    Payment must be made by VISA, MasterCard or American Express. Please complete the credit card section at the checkout page in full. By submitting your order, you represent that you are authorized to use the designated credit card and you authorize the LCBO to charge your order to that credit card. When entering your credit card information at the make payment stage, you must enter the billing address associated with your credit card. The LCBO reserves the right to obtain authorization from the issuer of that credit card and reserves the right to decline to accept any proposed credit card transaction.

  3. AVAILABILITY

    Every effort has been made to stock adequate quantities of the goods offered on the Website. Many of the goods, however, are available in relatively small quantities. Some items referred to on the Website may be or become out of stock.

    If the LCBO is unable to fill an order for a Product or Event Ticket ordered through the Website, you will be notified by e-mail or telephone and any amount charged to your credit card for the Product or Event Ticket will be credited as soon as possible.

  4. ORDER QUANTITIES

    The LCBO reserves the right to limit order quantities. The LCBO may reject an order if it appears that you are attempting to circumvent an order limit including, without limitation, where multiple orders are submitted with the same customer information.

  5. PRICING

    Prices quoted on the Website are in Canadian dollars. Prices are subject to change without notice.

  6. ERRORS

    The LCBO attempts to ensure that the information on the Website is accurate. However, no warranty of accuracy or completeness is expressed or implied. The LCBO expressly reserves the right to correct errors and to change or update information on the Website at any time without notice. If a Product offered on the Website is not as described, your only remedy is to return it for a refund. In the event of an error in an order confirmation, in processing an order, in delivering a Product or Event Ticket or otherwise, the LCBO reserves the right to correct the error and revise your order accordingly or to cancel the order and to refund any amount charged to you. Your only remedy in the event of an error is to cancel your order and to obtain a refund.

  7. GOVERNING LAW

    These Terms and Conditions and each purchase of Products or Event Tickets through the Website are governed by, and shall be construed in accordance with, the laws of the Province of Ontario.

  8. FORCE MAJEURE

    The LCBO shall not be liable for any for damages caused by any delay or failure to perform its obligations where such delay or failure is caused directly or indirectly by an event beyond its reasonable control including, without limitation, (i) acts of God, (ii) natural disasters, (iii) acts of war, insurrection and terrorism, (iv) strikes, lockouts and labour disputes, (v) government orders or regulations, or (vi) shortages of goods, labour or transportation.

  9. DISCLAIMER AND LIMITATION OF LIABILITY

    Except as expressly set out in these Terms and Conditions, there are no warranties, representations or other agreements regarding the Products or Event Tickets ordered through the Website. To the extent permitted by law, the LCBO shall not be liable to you for indirect, special, consequential, incidental or punitive damages (including, without limitation, damages for or in relation to lateness in delivery, loss of revenue or profits, or the cost of substitute goods), arising directly or indirectly from any breach of contract (fundamental or otherwise) or from any warranties contained herein, or from any acts or omissions that may give rise to legal liability (whether in tort, including for negligence, strict liability or under any other theory of legal liability), regardless of whether or not such damages were foreseeable. In no event shall the liability of the LCBO arising out of or related to any order exceed the total amount paid by you pursuant to such order.

  10. DISCONTINUANCE

    The LCBO may discontinue or suspend, temporarily or permanently, any presently available Products or Event Tickets at any time without prior notice.

TERMS AND CONDITIONS SPECIFIC TO ORDERS FOR PRODUCTS

The Terms and Conditions in this section apply only to the sale of Products.

  1. AGE

    You must be 19 years of age or older to purchase Products. By submitting an order for Products, you represent that you are 19 years of age or older and you are not purchasing Products for anyone who is younger than 19 years of age. When you pick up the Products you order you may be required to present proof that you are 19 years of age or older. Acceptable proof includes a valid driver’s licence, passport, citizenship card and BYID photo identification card.

  2. REFUNDS

    Customers may return any product (except gift cards) that is in saleable condition (including Vintages products and beer purchased as a Regular or Tax Exempt Sale) to any LCBO store provided it is accompanied by the original receipt within thirty (30) days of purchase. The Customer will be refunded in the applicable tender as used for the purchase (i.e. debit/cash purchases returned as cash, credit card purchases returned to original credit card, gift card purchases returned to a gift card, all mobile or near field purchases will be returned to credit card of origin.)

    All product returns require the customer’s name, address and telephone number and the customer’s signature to acknowledge receipt of the refund. Customers returning product must also show valid, government-issued photo ID to verify their identity. If a customer does not provide this information, the return will not be processed (see “Collection of Personal Information” section below).

    Refunds will not be provided to returns without a receipt. Gift Cards are final sale and are non-refundable.

  3. DELIVERY

    Products ordered will be delivered to an LCBO store for pickup. Pick up is available from any LCBO store. The LCBO does not guarantee the delivery time of any order. Orders must be paid in full before they will be delivered to an LCBO store.

    You will be contacted for pick up using the telephone contact information in your online file. When you pick up Products, you must present a copy of your final receipt (which will be mailed or emailed to you), the credit card used to purchase the Products, and photo ID.

    Title to Products passes from the LCBO to you when you pick up the Products from the LCBO.

    IMPORTANT: If you do not pick up Products within twenty one (21) days after they are available for pick up, the LCBO may cancel your order, in which case the LCBO will issue you a refund by cheque subject to any deposit forfeiture if applicable.

  4. DELIVERY CHARGES

    There are no delivery charges for Products shipped to an LCBO store.

  5. ALLOCATION ORDERS

    Certain Products are available in limited quantities. The LCBO may indicate on the Website that the available inventory of such Products will be allocated among the orders (referred to as “Allocation Orders”) it receives prior to the ordering deadline. The LCBO reserves the right to allocate available inventory among Allocation Orders in such proportions as it deems fit, in its sole discretion. Accordingly, the quantity specified by you in an Allocation Order may be reduced by the LCBO, in its sole discretion. The LCBO will notify you regarding the quantity of Products that is allocated to you.

  6. HIGHLY ALLOCATED PRODUCTS

    Certain Products are available in extremely limited quantities due to the rare or collectible nature of the Product (“Highly Allocated Products”) As a result of producer-imposed requirements, your purchase of a Highly Allocated Product is subject to the following conditions:

    1. Highly Allocated Products cannot be offered for sale on a secondary market, including but not limited to auctions and online marketplaces, regardless of whether such sale may be authorized under the Liquor Licence and Control Act, 2019.
    2. Highly Allocated Products may be subject to bottle code monitoring to identify any bottles sold by the LCBO that appear for resale on secondary markets.
    3. If you purchase a Highly Allocated Product from the LCBO and if the LCBO has reason to believe you resold that Highly Allocated Product in a secondary market contrary to these Terms and Conditions of Sale, the LCBO may, in its sole discretion, temporarily restrict you from making further purchases of any Highly Allocated Product.
    4. You must notify the LCBO if a Highly Allocated Product purchased from the LCBO is subsequently stolen. Failure to inform the LCBO of a theft may, if the Highly Allocated Product is identified for sale in a secondary market, result in the LCBO temporarily restricting you from further purchases of Highly Allocated Product.

    The LCBO will provide notice on the product offer page on vintagesshoponline.com, in advance of purchase, wherever these obligations apply. Should you have any questions regarding Highly Allocated Products, please contact the LCBO’s Merchandising Department at MerchandisingSupport@lcbo.com.

  7. DEPOSIT and BALANCE OWING

    Certain Products are not immediately available for delivery (e.g., Products offered through the Bordeaux Futures program). The LCBO may indicate on the Website that such Products (referred to as “Future Delivery Orders”) will be available to purchase subject to delivery at a later date when such Products are received by the LCBO. For Future Delivery Orders, you must pay a non-refundable/non-transferable deposit (i) when you submit your order, or (ii) in the case of a Product that is subject to allocation under section 14, once the LCBO notifies you of the Product quantity that is allocated to you. The amount of the deposit is 25% of the purchase price (or such other amount as stated in the ordering instructions). You must pay the deposit and acknowledge you are aware the deposit is non-refundable/non-transferable (i) at the time you submit your order, or (ii) in the case of a product that is subject to allocation under section 14, within the time specified in the Allocation Notice. The LCBO will notify you when the Products are ready to be delivered to an LCBO store for pick up, at which time you must pay the balance of the price for such Products. The LCBO may cancel your order if (i) the required deposit is not received when due; (ii) the LCBO is unable to contact you when the Products ordered are ready to be delivered for pick up, using the contact information you provided in your order, or (iii) the balance of the price owing is not received when due. If the LCBO cancels your order your deposit will be forfeited.

TERMS AND CONDITIONS SPECIFIC TO ORDERS FOR EVENT TICKETS

The Terms and Conditions in this section apply only to the sale of Event Tickets.

  1. LICENSE

    Each Event Ticket is a revocable license to attend a particular event, and is subject to these Terms and Conditions.

  2. FINAL SALE

    Before submitting your order for Event Tickets, carefully review the event date, time, and venue. Once purchased, Event Tickets are non-refundable.

    Special exception may be made in those instances where you have recently (i) tested positive for COVID-19, or (ii) have come into close contact with someone who has tested positive for COVID-19. You can take this customer screening questionnaire to determine whether you are eligible to attend the event: https://covid-19.ontario.ca/screening/customer/.

    No refunds will be issued to patrons who fail to comply with the applicable public health guidelines [at the time of the event].

  3. ORDERING PRODUCTS AT EVENTS

    Attendance at an event does not guarantee that order requests by event participants will be filled, as products may be limited and/or may sell out. VINTAGES reserves the right to apply limits on any product in the interest of equitable distribution. Prices may change without prior notice.

  4. PRINTING EVENT TICKETS

    You must print Event Tickets purchased through the Website. You must present a valid Event Ticket/and or identification to be admitted to the event. You will not be able to gain admission with any other form of document/proof of purchase.

  5. SAFEKEEPING OF EVENT TICKETS

    The holder of a valid Event Ticket will be able to gain admission to the LCBO event. You are responsible for the safekeeping of Event Tickets. The LCBO assumes no responsibility for Event Tickets that are lost or stolen or copied without your authorization.

  6. EVENT TICKET ORDER CONFIRMATION

    If you do not receive an order confirmation after submitting payment information, or if you experience an error message or service interruption after submitting payment information, or if you are not able to print the Event Ticket, it is your responsibility to contact LCBO Customer Service at 1-800-668-5226 or www.helloLCBO.com to confirm whether or not your order has been received and accepted. You are the only person who may be aware of any problems that may occur during the order process. The LCBO will not be responsible for losses (monetary or otherwise) if you assume that an order was not placed because you failed to receive confirmation.

  7. CANCELLED or POSTPONED EVENT

    The LCBO, at its sole discretion, may cancel or postpone an event. Should this occur, we will attempt to contact you to inform you of the refund or exchange procedures for that event.

    If an event is cancelled, and you purchased your Event Ticket through the Website, we will contact you to issue you a refund to the credit card that you used to purchase that Event Ticket.

    If the event is moved or rescheduled, we will contact you to (i) issue you a new Event Ticket for the new date, time or venue or (ii) issue a refund to the credit card that was used to purchase that Event Ticket.

  8. MULTIPLE BROWSER WINDOWS

    When ordering Event Tickets using the Website, please ensure you are looking for Event Tickets and placing an order using only one browser window. Looking up Event Tickets using multiple browser windows could result in losing your Event Tickets or timer expiration.

  9. LIMITATION OF LIABILITY

    The LCBO may, in its discretion, accommodate special requests made at the time that an Event Ticket is purchased. However, you voluntarily assume all risks and danger incidental to the event for which an Event Ticket is issued, whether before, during or after the event, and you waive any claims for personal injury or death against the LCBO, management, facility, participants, and all of their respective parents, affiliated entities, agents, officers, directors, owners and employees.

TERMS AND CONDITIONS SPECIFIC TO AEROPLAN

  1. ELIGIBILITY & EARNING POINTS

    To be eligible to earn Aeroplan points (“Aeroplan Points”) with the Liquor Control Board of Ontario (“LCBO”) you must be an Aeroplan member (“Aeroplan Member”) and have an Aeroplan account in good standing, all in accordance with Aeroplan’s Terms and Conditions (the “Aeroplan Program”)

    Only transactions made at LCBO retail stores, the lcbo.com website, the LCBO mobile application, and on Vintages Shop Online are eligible for earning Aeroplan Points. Please visit lcbo.com to find your nearest LCBO retail store location (each, an “LCBO Retail Location”).

    Only transactions made for non-commercial purposes are eligible for earning Aeroplan Points. Transactions that are not eligible to earn Aeroplan Points include purchases made on behalf of LCBO Convenience Outlets or agency stores, purchases made by agents representing manufacturers/suppliers, purchases made by licensees, and purchases made on behalf of an end consumer facilitated through a third party on-demand delivery platform (each, an “Ineligible Purchase”).

  2. HOW TO EARN POINTS

    To earn Aeroplan Points, simply (i) present your Aeroplan Member card at the check-out when you make a purchase at an LCBO Retail Location or, (ii) if you are making a purchase on the Vintages Shop Online website, add your Aeroplan Member card number to your Vintages Shop Online account profile and you will earn Aeroplan Points with each qualifying Vintages Shop Online purchase.

    Purchases made at any LCBO Retail Location or on the Vintages Shop Online website prior to (i) an individual’s enrolment in the Aeroplan Program, or, (ii) November 16, 2021 are not eligible for the accumulation of Aeroplan Points.

  3. RETURNS

    In the event of a return or exchange relating to a transaction that has resulted in an accrual of Aeroplan Points, any Aeroplan Points earned on that transaction will be automatically adjusted (whether or not the Aeroplan Card is presented at the time of return or exchange). Adjustments may be made to Base Points and any Aeroplan Points earned through Product Bonus Offers. The final total of Aeroplan Points earned for your transaction will be available in your Aeroplan Member account.

  4. ADJUSTMENTS (ERRORS) & DISCREPANCIES

    Aeroplan Points displayed on your transaction record at the time of purchase are estimates only and do not necessarily reflect the final amount of Aeroplan Points that will be issued to you. The LCBO reserves the right, in its discretion, to add, remove, make adjustments to, and/or correct any errors in, the amount of Aeroplan Points issued to Aeroplan Members, at any time and for any reason, with or without notice, including, without limitation, as a result of: (a) Aeroplan Points being erroneously earned or credited to your Aeroplan Member account; (b) issues with order fulfilment or product unavailability, for any reason; (c) issues with payment processing; and (d) Aeroplan Points earned at an incorrect, higher earn rate.

    In the event of any discrepancy relating to Aeroplan Points earned at LCBO Retail Locations or through the Vintages Shop Online website, please contact LCBO Customer Care at 1-800-668-5226 or via hello_lcbo@lcbo.com. The LCBO must be notified within twelve (12) months of the date on which the transaction relating to the discrepancy occurred. Only those discrepancies that are accompanied by an original receipt will be considered for adjustment.

    For transactions in LCBO Retail Locations where the customer failed to present its Aeroplan Member card at the time of purchase, the customer may request the applicable Aeroplan Points by returning to the same LCBO Retail Location, only on the same day as the applicable transaction, with the original receipt and your Aeroplan Member Card. Otherwise, for transactions on Vintages Shop Online, contact LCBO Customer Care at 1-800-668-5226 or via hello_lcbo@lcbo.com to make your request within twelve (12) months of the transaction.

    The final total of Aeroplan Points earned for your transaction will be available in your Aeroplan Member account.

  5. OFFERS

    Base Points Offer
    Earn one (1) Aeroplan Point for every $4.00 spent (excluding taxes, container deposits, gift cards and charity donations) at LCBO Retail Locations or on Vintages Shop Online (the “Base Points”). The total Aeroplan Points earned will be rounded down to the nearest whole Aeroplan Point.

    Example: $18.90/$4.00 = 4.725, which will be rounded down to 4 Aeroplan Points earned.

  6. BONUS POINTS OFFERS – PRODUCTS

    Select products may, in the LCBO’s discretion, be available at LCBO Retail Locations with time-limited bonus offers (“Product Bonus Offers”). The amount of bonus Aeroplan Points earned per product and the duration of the Product Bonus Offers may vary and are subject to change by the LCBO, without notice. All Product Bonus Offers are applicable only while supplies last. Not all LCBO Retail Locations will feature the same in-store Product Bonus Offers.

  7. OTHER TERMS

    Participation in the LCBO Aeroplan Program constitutes acceptance of these Terms and Conditions, along with Aeroplan’s Terms and Conditions. Offers may be added, removed or changed at any time, in the LCBO’s discretion. LCBO and Aeroplan reserve the right to terminate your participation in these offers if you violate any of these Terms and Conditions. For Aeroplan Product Bonus Offers, please allow 6-8 weeks after the Product Bonus Offer ends to receive the bonus Aeroplan Points.
